Ben Prell assists clients in resolving all manner of business disputes.  He has handled matters that include business ownership and control disputes, non-competition agreements, contract breaches, employment disputes, securities fraud, misappropriation of trade secrets, and intellectual property infringement.  He provides advice and counsel to businesses regarding litigation and regulatory risk management, compliance with federal regulations, and contract negotiation, revisions and updates.   He has also litigated and arbitrated securities industry disputes, advised professionals and firms in the securities industry on regulatory issues, and has defended them in actions brought by the Securities and Exchange Commission (SEC), state securities agencies, and the Financial Industry Regulatory Authority, Inc. (FINRA).

Ben’s recent work includes the successful resolution of cases involving the disputed ownership and control of multiple businesses, a wrongful termination claim by a minority shareholder, a securities fraud claim, a partnership claim related to the development of a cellulosic ethanol plant, and a contract dispute involving information technology services.  Of particular note, Ben won an extremely favorable defense verdict that severely restricted the attempted enforcement of an overly-broad non-competition agreement. The verdict allowed his client’s new out-of-state employer to continue its important expansion plans into the Kansas City area.  His efforts on behalf of his clients led to his recognition as one of Kansas and Missouri’s Rising Stars by Super Lawyers® in 2011 and 2013-2017.  Ben holds a “Superb” rating from Avvo.com.

Ben graduated cum laude from American University’s Washington College of Law, and earned a Bachelor of Arts in Government with a minor in Criminal Justice, magna cum laude, from Northwest Missouri State University. While in law school, he obtained a security clearance and worked with the Public Corruption and Government Fraud section of United States Attorney’s Office for the District of Columbia. In that capacity, he assisted federal prosecutors on sensitive investigations and complex prosecutions involving public officials and government employees.

He is licensed to practice in Missouri, Kansas, and Virginia, and is a member of the Missouri and Kansas Bar Associations, the Kansas City Metropolitan Bar Association (KCMBA), and the Virginia Bar.  Ben began his career with a well-known national law firm based in St. Louis, where he was a member of its business services group.  Ben is an active participant in the Kansas City Metropolitan Bar Association, recently editing the Business Litigation Committee’s updated Business Litigation Handbook and drafting a chapter on oral and implied partnerships. He has also served as a past chair and co-chair of the Securities Law Committee, and was previously member of the Missouri Securities Advisory Committee for the Missouri Secretary of State, Securities Division.

Ben grew up in the Kansas City area, and aside from time away for college and law school, he has lived in KC his entire life. When he isn’t busy helping clients, Ben enjoys spending time with his wife Stephanie, playing with his son Matthias, and following the 2015 World Champion Kansas City Royals.
