Benjamin Prell assists clients in resolving all manner of business disputes. Ben’s recent work includes the successful settlement of cases involving the disputed ownership and control of a business, a securities fraud claim, the development of a cellulosic ethanol plant, an employment agreement and commission claim, and a contract dispute involving information technology services.  Of particular note, Ben won an extremely favorable defense verdict that severely restricted the attempted enforcement of an overly-broad non-competition agreement. The verdict allowed his client’s new out-of-state employer to continue its important expansion plans into the Kansas City area. In addition to these cases, Ben has prosecuted and defended a variety of business and commercial cases including disputes regarding oral partnership agreements, breach of contract, negligent and fraudulent misrepresentations, trade secret and intellectual property misappropriation, and secured transactions. His efforts on behalf of his clients led to his recognition as one of Kansas and Missouri’s Rising Stars by Super Lawyers® in 2011 and 2013-2016.

Ben is also experienced in securities industry matters. He has litigated and arbitrated securities industry disputes, advised clients regarding securities regulatory matters, and defended clients against enforcement actions by the SEC, FINRA, and state securities regulators. Ben has counseled investment professionals and firms regarding registration and employment issues, including litigation and FINRA arbitration involving industry disputes such as restrictive employment agreements and forgivable loans.

Ben graduated cum laude from American University’s Washington College of Law (WCL), and earned a Bachelor of Arts in Government with a minor in Criminal Justice, magna cum laude, from Northwest Missouri State University. While attending WCL, he worked for the United States Attorney’s Office for the District of Columbia, assisting federal prosecutors in the Fraud and Public Corruption Section. He also was a member of WCL’s Mock Trial Team, and participated in the highly regarded D.C. Law Students in Court Program.

He is licensed to practice in Missouri, Kansas, and Virginia, and is a member of the Missouri and Kansas Bar Associations, the Kansas City Metropolitan Bar Association (KCMBA), and the Virginia Bar.  He has served as both the Chair and Vice-Chair of the KCMBA Securities Law Committee, subcommittes of the KCMBA Business Litigation Committee, and as a member of the Missouri Securities Advisory Committee for the Missouri Secretary of State, Securities Division.

Ben grew up in the Kansas City area, and aside from time away for college and law school, he has lived in KC his entire life. When he isn’t busy helping clients, Ben enjoys spending time with his wife Stephanie, playing with his son Matthias, and following the 2015 World Champion Kansas City Royals.
